The site observes the Consumer Code (Legislative Decree no. 206/05) which provides precise obligations for the seller as well as specific rights for the customer.Please read carefully the conditions listed below, print and/or save them on another reliable device.

1. Definitions

For the purposes of these general conditions of sale, and in addition to other definitions referred to therein, the following terms have the meanings set forth below:

General Conditions: all the conditions of sale, applicable to the contractual relationship between Townet and the Customer.

Townet is the company that wants to make the sale through this website at http://www.wispmax.com  and other Internet addresses registered by Townet srl.

Products: all products and/or goods sold by Townet and being part of its range.

Site: is the set of Web pages related to http://www.wispmax.com,  http://www.mikrotik-italy.comhttp://www.poynting.it.

Order: is the purchase order with home delivery of products.

2. Scope – Effects

The General Conditions shall apply to any sale concluded between the customer and Townet and made through the Site.The dispatch of an order implies acceptance by the Customer of these Conditions;

The General Conditions relate to both the sale to a consumer customer and a sale to a customer who buys for purposes related to his business or profession or occupation where he had purchased with VAT, with related issuance of invoices.;

any changes or new conditions of sale will become effective when posted on the Website and will be applied only to sales made after publication.

3. Contract formalization

The contract is concluded, and is binding for both parties, when Townet receives the notification of payment.A thank you e-mail is sent with an automated system to the customer at the receipt of the order. This thank you e-mail should not be considered as a confirmation of the order, but only as a confirmation of receipt of the order.

Townet also reserves the right (at its full discretion) not to accept/dispatch some orders: in that case, if the customer has already made the payment, the full amount is repaid.

The payment of orders can be made through the methods indicated.
The choice of a method of payment can result in an extension of times for the dispatch of orders.

Payments by credit card from outside Italy require the sending of a personal documento. After the creation of the account, the customer must send a valid identity card (eg. ID card of the credit card owner). This procedure is valid only for the first purchase.

Payments must be made within 5 days otherwise the order will be canceled automatically. The availability of the goods ordered is not confirmed until the receipt of payment. The order will be processedon the date of the actual crediting. Communications of the payment by the customer via email or fax will not be taken into account.  The verification is performed automatically by our bank.

The customer may cancel the order within a maximum of 12 hoursfrom its payment. After these 12 hours from these events, ALL orders are definitively confirmed. Exceptions to this paragraph may be accepted by Townet from time to time.Order cancellations may be made by e-mail.

The refund will be made within 30 days of the order.

In any case, once the product has been delivered by Townet to the carrier, ORDERS CAN NOT BE CANCELED ANYMORE BY THE CUSTOMER, WHO CAN STILL CLAIM THE RIGHT OF WITHDRAWAL.

4. Times and delivery modalities

Townet guarantees maximum care and professionality in boxing the products, limiting the risk of damage during the shipping.

All customers that buy on Wispmax portal are advised via e-mail at the time of product departure from our warehouse. They will receive tracking number for monitoring the shipment on the courier webpage.

The courier is chosen by Townet on the basis of the weight and the destination of the goods and it can be visualized by the customer during the order checkout. All shimpments, except when the customer choose his own courier, are made by one of the standard Townet couriers and the shipment fee will be charged to the customer as specified in the order. If the courier is appointed by the customer (My Own Courier) Townet will not be responsible of eventual loss or damage since the goods leave our warehouse.

The order is subjected to three status changes that can be visualized from the customer in his administration panel. Once the order is forwarded it is classified in “Pending Payment” (if the payment method is credit card or Paypal) and “Pending” (if the payment method is Money Transfer). Once the payment is received the order status changes in “Processing” and the order is processed. Once the order is shipped the customer will receive an e-mail of shipping done and the order status will change in “Complete“. In case of payment not successfully concluded, or in case of voluntary cancellation by the customer, the order status switches to “Canceled“. Orders whose payment is not received within seven days (in the case of payment by bank transfer) or within one day (in the case of payment by credit card) are automatically canceled. 

Order processing is done within maximum 24 hours from payment receipt. Orders are processed in chronological arrival order. Customers who want to have prioritary shipping can use the Urgency Ticket (service with fee) that provides for passing over the orders queue (saturdays, sundays and holidays are excluded in any case). Orders with Urgency Ticket will in any case be processed after payment receipt.

Shipping times can be subjected to variations due to force majeur (traffic and weather conditions, strikes, Authority act). Possible delays due to this cannot be attributed to Townet. 

In the Wispmax homepage you will always find communications about holiday closings.

Orders already paid can not be modified. Orders containing components which are not available, as reported in the product data sheet, will not be processed until full availability. Eventual free shipping is applied only in case of unique shipment of the whole material. If all the goods are not available at 24H, for partial shipments Carriage Forward is applied. 

Orders will be delivered into sealed envelopes or parcels; for organizational reasons of efficiency and economy of service, orders can not be opened, checked or controlled by the Customer before their payment.

Fiscal documents (invoices and / or receipts) are issued by Townet, by e-mail, and / or with invoices physically attached to the parcel;

5. Prices

All the selling prices of the products shown on the site are in Euro;

Unless otherwise stated, the prices of products are exclusive of VAT.

prices for individual products, from time to time reported on the site, cancel and replace the previous;

the prices charged are those shown on the site at the time of the purchase by the customer, without any consideration of increases or decreases in prices that may have occurred subsequently;

in case of modification of an order, the price of new products will be the one shown on the website at the moment of the modification in the case of products different from those included in the original order, while the price shown at the moment of the order will still be appliable if the case that the modification only concerns the quantity of products already ordered.

6. Townet Responsibility

Townet assumes no liability for outages due to force majeure of any kind and nature, if it is unable to observe the times agreed in the contract. Some events of majeure force can be, included but not limited to, decisions of public authorities, strikes of our own employees or carriers used by Townet, and any other circumstance beyond the control of Townet.

7. Customer Obligations

The Customer egrees to print and store these General Conditions;

the information contained in the General Conditions must be read and accepted by the Customer before the purchase order, that in order to fully satisfy the conditions laid down in Articles. 52 and 53, Legislative Decree No. 206/2005.

Acceptance is made by marking the proper space on the site. Failing that, the order can not be executed.

For all orders placed by mail / fax the conditions of sale are considered implicitly accepted.

8. Right of withdrawal

Under article 64 of the Legislative Decree No. 206/2005, a Customer that for some reason is not satisfied with his purchase, has the right to withdraw from the contract and return the ordered Products already delivered,  without penalty and without giving any specific reason;

the right of withdrawal must be exercised by the Customer by sending a registered letter to TOWNET SRL Via dei Finale, 20 61043 Cagli (PU) – Italy, within ten working days from the receipt of the order;

the communication above-mentioned can be sent, within the same period, also by telegram or fax (+39 0721 796182) or e-mail (info@wispmax.com), if confirmed by a registered letter within 48 hours after sending the telegram. Fax or e-mail;

if the withdrawal is carried out in accordance with the conditions above, the amount paid for the products and the delivery charge is credited to the buyer by bank transfer to his bank account;

The reimbursement is free and is made as soon as possible and in any event within 30 days from the date on which Townet becomes aware of the right of withdrawal by the Client;

within 10 working days from the exercise of the right of withdrawal, the customer must send or deliver the goods to the following address: Via dei Finale, 20 61043 Cagli (PU) – Italy.

The products must be returned undamaged, unused and in their original packaging; Townet reserves the right to withhold money from the reimbursement made to the customer as a partial or total coverage of the cost of reconditioning of the product if it is used or not returned in its original packaging.

the only expenses paid by the customer to exercise the right of withdrawal is the direct return of the Products to Townet;

Under no circumstances cash on delivery or carriage forward packages will be withdrawed.

According to what provided by Article 55 – paragraph 2 – Legislative Decree 206/2005 the consumer can not exercise the right of withdrawal in case of sealed audiovisual or computer products, opened by the Customer.

Reimbursements and/or the right of withdrawal do not include the purchase of any software license.

The right of withdrawal lapses completely for lack of the essential condition of integrity of the goods (the packaging and/or its contents), where Townet finds out:

The use, even partial, of the goods and any consumables

The lack or damage of the outer packaging and / or internal packaging

The lack of integral elements of the product (accessories,cables,manuals,parts,…)

Damage to the product for reasons other than transportation

In the cases above, Townet will return the item purchased to the sender, charging the shipping costs to him.

The consumer may not exercise the right of withdrawal if he purchases for purposes related to his business or profession or occupation or where he purchases with VAT, with the related issuance of invoice.

9. Limitations of liability

The Company shall not be liable for any damages resulting from misuse of products. The Company shall not be liable for any damages, whether as a result of the work of its agents, except in cases of gross negligence and willful misconduct.The Customer shall inspect the goods after the delivery and give written notice to the Company without delay of any damages, defects, etc. The company warrants the product against manufacturing defects recognised for one year after delivery(to subjects with VAT) or for two years (to subjects with Tax Code) provided that the customer gives written notice of the defects or noncompliance to the company within a week from the discovery. In this case the company will be only liable, alternatively for:

1. replacing the defective goods (where the goods are returned within 7 days from the date of delivery);

2. repairing the goods (where the goods are returned within 7 days from the date of delivery)

provided that the customer gives notice of the defects and returns the defective goods.

With regard for the time for repair, the company will not be liable for them, since he devices must be sent to their manufacturer to be repaired.

10. Warranty

In accordance with the Codice del Consumo (art. 130) the warranty on products sold on Wispmax.com is 1 year for companies (VAT number holder) and 2 years for the consumer (private with Tax Code).The warranty does not cover the products that result to be broken or repaired by third parties or used not in accordance with the conditions of use provided.

The products considered defective, that in the sole discretion of the supplier result to be actually defective, can be repaired or replaced but it does not involve any liability for the Supplier for possible direct or indirect damages.

Requests for return must be sent to Townet in writing and should be sent to info@wispmax.com

The Purchaser, once received the authorization for return is required to send at his own risk and expense the defective product.

Following the request, if it is authorized a return code number is communicated to the customer.

The customer must send the goods to be returned to the address that will be communicated, indicating clearly visible the code ha has received on the package.

All the products that will be sent to assistance without the authorization of Townet will not be accepted. The costs for returning these products must be borne by the Purchaser.

The equipment must be shipped freight prepaid, or it will not be withdrawed by the collection center.

The equipment will be checked first, then it will be decided, depending on the circumstances, whether to replace them or send them for repair.

The warranty for consumables such as lamps, batteries and things like that is limited to 30 days after delivery or shipment.

The shipping costs for sending equipment to the manufacturer, its return from the manufacturer and the return to the customer are borne by Wispmax.

If a RMA product is PERFECTLY FUNCTIONING or OUT OF WARRANTY, the Customer must buy a Fixed Charge Ticket for every product in RMA. After the purchase of the fixed charge ticket, Wispmax will ship the product back at Customers’ expenses.

11. Liability

With the order the purchaser assumes responsability for complying with laws and safety requirements regarding the use of the prodcuts purchased.

Is therefore excluded any liability of the Supplier for any direct or indirect damage caused to persons and things by the misuse of the products supplied.

In no case the Supplier shall be held responsible, even indirectly, for the failed or insufficient functioning of the products and/or consequential damages.

12. Applicable law and remand

Contracts stipulated online by the Customer with Townet are governed by Italian law;

even if not expressly provided here, the norms of the law applicable to the relationship and the cases stipulated in the contract signed by the Customer with Townet are valid;

Under Articles 1341 and 1342, the Customer declares that he has read and accepted expressly the terms of the General Conditions of Sale of Townet.

Il sito osserva il Codice del Consumo (D. Lgs. 206/05) il quale prevede precisi doveri per il venditore e altrettanto precisi diritti per il Cliente. Ti invitiamo a leggere attentamente le condizioni sotto riportate, ed a stamparle e/o salvarle su altro supporto duraturo a tua scelta.

1. Definizioni

Ai fini delle presenti condizioni generali di vendita, ed in aggiunta alle altre definizioni ivi contemplate, i seguenti termini avranno il significato qui di seguito riportato:

Condizioni Generali: sono tutte le condizioni di vendita, applicabili al rapporto contrattuale intercorrente tra Townet ed il Cliente

Townet è la società che intende effettuare la vendita tramite il sito presente all’indirizzo http://www.wispmax.com ed altri indirizzi internet registrati da Townet s.r.l.

Prodotti: sono tutti i prodotti e/o le merci commercializzati da Townet e facenti parte del proprio assortimento.

Sito: è l’insieme delle pagine Web relative a http://www.wispmax.com, http://www.mikrotik-italy.com , http://www.poynting.it.

Ordine: è l’ordine di acquisto con consegna dei Prodotti a domicilio del Cliente.

2. Ambito di applicazione – Effetti

Le Condizioni Generali si applicano a qualsiasi vendita conclusa tra il Cliente e Townet ed effettuata tramite il Sito. L’invio di un ordine implica l’accettazione da parte del Cliente delle presenti Condizioni Generali;

le Condizioni Generali concernono sia la vendita ad un Cliente consumatore, sia la vendita ad un cliente che acquista per finalità inerenti la propria attività lavorativa imprenditoriale o professionale ossia laddove avesse acquistato con Partita IVA, con relativa emissione di fattura.;

eventuali modifiche o nuove condizioni di vendita saranno efficaci dal momento della pubblicazione sul Sito e verranno applicate alle sole vendite concluse successivamente alla pubblicazione.

3. Formalizzazione contrattuale

Il contratto si intende concluso, ed è vincolante per entrambe le parti, nel momento in cui Townet riceve notifica di avvenuto pagamento. Viene trasmessa con sistema automatico un’e-mail di ringraziamento al cliente generata automaticamente alla ricezione dell’ordine. Tale e-mail di ringraziamento non deve essere considerata come conferma dell’ordine, ma soltanto come conferma di avvenuta ricezione dell’ordine.

Townet si riserva altresì la facoltà (a propria integrale discrezione) di non accettare/evadere ordini: in tal caso, se il cliente ha già provveduto al pagamento dell’ordine, l’intero importo viene rimborsato.

Il pagamento degli ordini può avvenire attraverso le modalità indicate.

La scelta della modalità del pagamento potrà comportare un prolungamento del tempi di evasione degli ordini.

Il pagamento con carta di credito da fuori dell’Italia richiede l’invio di un documento di identità valido (ad es. carta d’identità dell’intestatario della carta di credito) a info@wispmax.com. Questa procedura è valida soltanto per il primo acquisto e non verrà più chiesto alcun documento per gli acquisti successivi.

È possibile eseguire il pagamento tramite bonifico bancario alle seguenti coordinate: INTESA SAN PAOLO S.p.A. AG. ACQUALAGNA IBAN: IT65N0306968190100000000598 , BIC/SWIFT: BCITITMM , INTESTATO A : TOWNET SRL   . I pagamenti devono essere eseguiti entro 5 giorni altrimenti l’ordine sarà annullato automaticamente. La disponibilità della merce ordinata non viene confermata fino al ricevimento del bonifico. L’ordine sarà processato alla data di effettivo accredito. Comunicazioni di avvenuto pagamento da parte del cliente tramite email o fax non verranno prese in considerazione. La verifica viene eseguita automaticamente dalla nostra banca.

Il cliente ha facoltà di annullare l’ordine entro massimo 12 ore dall’inoltro dello stesso ovvero dal saldo dello stesso. Trascorse 12 ore da questi eventi TUTTI gli ordini si intendono confermati in via definitiva. Eventuali deroghe a questo punto potranno di volta in volta essere accettate da Townet. Gli annullamenti d’ordine possono essere fatti a mezzo e-mail.

Il rimborso dell’ordine verrà effettuato entro 30 giorni.

In ogni caso, una volta che il prodotto è stato consegnato da Townet al trasportatore NESSUN ORDINE POTRA’ PIU’ ESSERE ANNULLATO DAL CLIENTE, IL QUALE POTRA’ COMUNQUE RIVALERSI DEL DIRITTO DI RECESSO.

4. Tempi e modalità di consegna

Townet garantisce la massima cura e professionalità nell’imballaggio dei prodotti, garantendo il minimo rischio di ricevere la merce danneggiata. 

Tutti i clienti che acquistano sul portale Wispmax saranno avvisati via e-mail al momento della spedizione della merce e verrà indicato loro il codice necessario a monitorare la spedizione sul sito internet del corriere utilizzato.

L’utilizzo dei corrieri per la spedizione della merce viene valutato a seconda del peso dei prodotti acquistati e della località di spedizione e può essere visualizzato dal cliente in fase di ordine. Tutte le spedizioni, salvo il caso in cui si scelga proprio corriere, verranno effettuate tramite trasportatori definiti da Townet e le spese di spedizione addebitate al cliente come specificato nell’ordine. Nel caso in cui il trasportatore sia incaricato a qualsiasi titolo direttamente dal cliente, Townet non sarà responsabile della perdita e/o danneggiamento e/o avaria della merce fin dal momento della consegna della merce al vettore presso i nostri magazzini.

L’ordine, dal momento in cui viene ricevuto a quello in cui viene spedito, subisce tre cambi di stato, visualizzabili dal cliente nel suo pannello utente. L’ordine appena inoltrato viene classificato in “Pending Payment” se effettuato con carta di credito o Paypal, e in “Pending” se effettuato con modalità Bonifico Bancario. Nel momento in cui il pagamento viene ricevuto, lo stato passa in “Processing” e l’ordine viene processato. Nel momento in cui l’ordine è spedito, il cliente riceverà una e-mail di avvenuta spedizione e lo stato dell’ordine passerà a “Complete“. In caso di pagamento non andato a buon fine, oppure di cancellazione volontaria da parte del cliente, lo stato passerà in “Canceled“. Vengono automaticamente annullati gli ordini il cui pagamento non venga ricevuto entro sette giorni (nel caso di pagamento tramite bonifico bancario) o entro un giorno (nel caso di pagamento con carta di credito).

La processazione dell’ordine avviene entro massimo 24 ore dalla ricezione del pagamento. Gli ordini vengono evasi in ordine cronologico di arrivo. Tutti i clienti che vorranno ricevere una spedizione prioritaria rispetto alla tempistica standard, possono avvalersi del Ticket Urgenza (servizio a pagamento), il quale prevede priorità di gestione e spedizione rispetto alla fila degli ordini (rimangono sempre esclusi sabati, domeniche e festivi). Anche per il Ticket Urgenza, la processazione non avverrà prima dell’avvenuta contabilizzazione del pagamento. Nel caso in cui si abbia diritto alla Spedizione Gratuita (disponibile solo per ordini verso Italia) il supplemento per la spedizione urgentesarà comunque dovuto poiché il cliente si avvarrà comunque del servizio. 

I tempi di consegna possono subire variazioni per causa di forza maggiore, a causa di particolari condizioni di traffico e viabilità in genere, nonchè per atto delle Autorità. Eventuali ritardi dovuti a questo tipo di cause non sono imputabili a Townet. 

Gli ordini perfezionati con il pagamento non possono essere modificati. Gli ordini recanti componenti non disponibili come da segnalazione sulle schede prodotto non saranno processati fino alla completa disponibilità.  Pertanto si invita il Cliente a verificare l’effettiva disponibilità. Eventuali spese di spedizione grauite sono applicate in caso di spedizione unica dell’ordine. Se il materiale non è tutto disponibile, per ordini parziali sarà applicato il Porto Assegnato.

L’ordine verrà consegnata in pacchi o buste sigillate; per ragioni organizzative, di efficienza ed economia del servizio, l’ordine non potrà essere aperto, verificato o controllato dal Cliente prima del pagamento della stesso.

La documentazione fiscale (fattura e/o scontrino fiscale) viene rilasciata da Townet, mediante posta elettronica e/o mediante fattura accompagnatoria fisicamente acclusa al pacco;

5. Prezzi

Tutti i prezzi di vendita dei Prodotti indicati nel Sito sono espressi in Euro;

Salvo ove diversamente indicato, i prezzi dei Prodotti sono IVA esclusa.

i prezzi dei singoli Prodotti, di volta in volta indicati nel Sito, annullano e sostituiscono i precedenti;

i prezzi applicati sono quelli indicati nel Sito al momento dell’ordine di acquisto da parte del Cliente, senza alcuna considerazione di aumenti o diminuzioni di prezzo eventualmente intervenute successivamente;

in caso di modifica di un ordine, il prezzo dei nuovi prodotti sarà quello indicato nel sito al momento della modifica qualora si tratti di prodotti diversi da quelli oggetto dell’ordine originario, mentre rimarrà applicabile il prezzo indicato al momento dell’ordine qualora la modifica riguardi solo la quantità dei prodotti già ordinati.

6. Responsabilità di Townet

Townet non si assume alcuna responsabilità per disservizi imputabili a causa di forza maggiore di qualsiasi natura e genere, nel caso non riesca a dare esecuzione nei tempi concordati al contratto. Sono cause di forza maggiore, a titolo esemplificativo e non esaustivo, i provvedimenti della Pubblica Autorità, lo sciopero dei dipendenti propri o dei vettori dei quali Townet si avvale, nonché ogni altra circostanza che sia al di fuori del controllo di quest’ultima.

7. Obblighi del Cliente

Il Cliente si impegna a provvedere alla stampa ed alla conservazione delle presenti Condizioni Generali;

le informazioni contenute nelle Condizioni Generali vanno visionate ed accettate dal Cliente prima dell’invio dell’ordine di acquisto, ciò al fine di soddisfare integralmente la condizione di cui agli artt. 52 e 53 del D. Lgs. n. 206/2005. L’accettazione avviene mediante marcatura dell’apposito spazio presente sul sito. In mancanza di ciò, l’ordine non potrà essere eseguito.

Per tutti gli ordini fatti a mezzo mail/fax le condizioni di vendita si intendono implicitamente accettate.

8. Diritto di Recesso

Ai sensi dell’art. 64 del D. Lgs. n. 206/2005, il Cliente che per qualsiasi ragione non si ritenesse soddisfatto dell’acquisto effettuato, ha diritto di recedere dal contratto stipulato e di restituire i Prodotti ordinati eventualmente già consegnati, senza alcuna penalità e senza specificarne il motivo;

il diritto di recesso deve essere esercitato dal Cliente, mediante invio di lettera raccomandata A.R. a TOWNET SRL Via dei Finale, 20 61043 Cagli (PU) – Italy, entro il termine di dieci giorni lavorativi dal giorno di ricevimento dell’ordine;

la comunicazione di cui sopra può essere inviata, entro lo stesso termine, anche mediante telegramma o fax (+39 0721 796182) o e-mail ( info@wispmax.com), purché confermata, mediante lettera raccomandata A.R., entro le 48 ore successive all’invio del telegramma o fax o e-mail;

se il recesso è effettuato in ossequio alle condizioni sopra indicate, l’importo pagato per i Prodotti e per le spese di consegna è accreditato all’acquirente mediante bonifico bancario su conto a lui intestato;

Il rimborso è gratuito ed è effettuato nel minor tempo possibile, e in ogni caso entro 30 giorni dalla data in cui Townet viene a conoscenza dell’esercizio del diritto di recesso da parte del Cliente;

entro 10 giorni lavorativi dall’esercizio del diritto di recesso, il Cliente è tenuto a spedire o consegnare i prodotti resi al seguente indirizzo: Via dei Finale, 20 61043 Caglia (PU) – Italy.

I prodotti resi devono essere restituiti integri, non utilizzati e nella confezione originale; Townet si riserva la facoltà di trattenere soldi dal rimborso effettuato al cliente a parziale o totale copertura delle spese di ricondizionamento del prodotto qualora questo sia restituito utilizzato o comunque NON nella confezione originale.

le uniche spese a carico del Cliente per l’esercizio del diritto di recesso sono quelle dirette di restituzione dei Prodotti a Townet;

non vengono ritirati in nessun caso pacchi spediti in contrassegno né in porto assegnato.

In base a quanto previsto dall’ Art. 55 – comma 2 – D. Lgs. 206/2005 Il consumatore non può avvalersi del diritto di recesso in caso di fornitura di prodotti audiovisivi o di software informatici sigillati, aperti dal consumatore.

Sono inoltre esclusi rimborsi e/o diritto di recesso sull’acquisto di qualsiasi licenza software.

Il diritto di recesso decade totalmente, per mancanza della condizione essenziale di integrità del bene (confezione e/o suo contenuto), nei casi in cui Townet accerti:

Utilizzo anche parziale del bene e di eventuali materiali di consumo

La mancanza o il danneggiamento della confezione esterna e/o dell’imballo interno originale

L’assenza di elementi integranti del prodotto (accessori,cavi,manuali,parti,…)

Il danneggiamento del prodotto per cause diverse dal suo trasporto

Nei casi sopra indicati, Townet provvederà a restituire al mittente il bene acquistato, addebitando allo stesso le spese di spedizione.

Il consumatore non può esercitare tale diritto di recesso se acquista per finalità inerenti la propria attività lavorativa imprenditoriale o professionale ossia laddove avesse acquistato con Partita IVA, con relativa emissione di fattura.

9. Limitazioni di responsabilità

La Società non sarà responsabile di eventuali danni derivanti da usi impropri dei prodotti. La Società non sarà responsabile per eventuali danni, anche a seguito dell’operato di suoi ausiliari, salvo i casi di colpa grave e dolo. Il Cliente si obbliga ad esaminare la merce all’atto della ricezione e a comunicare per iscritto alla Società senza ritardi eventuali danni, difetti ecc. La Società garantisce il prodotto contro i difetti riconosciuti di fabbricazione per un anno dalla consegna (ai soggetti con P. IVA) o per due anni (ai soggetti con Codice Fiscale) a condizione che il cliente comunichi per iscritto alla società i difetti o le non conformità entro una settimana dalla scoperta. La società in detto caso sarà esclusivamente responsabile, alternativamente di:

1. sostituire la merce difettosa (nel caso in cui la merce venga resa entro 7 giorni dalla data di consegna);

2. riparare la merce (nel caso in cui la merce venga resa dopo 7 giorni dalla data di consegna)

a condizione che il cliente dia prova dei difetti e restituisca la merce difettosa.

Relativamente ai tempi di riparazione, la società non sarà responsabile dei tempi di effettuazione degli stessi, poiché gli apparati dovranno essere inviati in riparazione al Costruttore degli stessi.

10. Garanzia

Ai sensi del Codice del Consumo (art. 130) la Garanzia sui prodotti venduti nel portale Wispmax è di 1 anno per le aziende (titolari di partita IVA) e 2 anni per il consumatore finale (acquirente privato che acquista con Codice Fiscale). La garanzia non copre i prodotti che risultano manomessi, riparati da terzi o utilizzati non conformemente alle condizioni d’impiego previste.

I prodotti ritenuti difettati, che a insindacabile giudizio del Fornitore risultassero effettivamente difettosi, potranno essere riparati o sostituiti senza che ciò comporti per il Fornitore responsabilità alcuna per eventuali danni diretti o indiretti.

Le richieste di rientro dovranno pervenire a Townet per iscritto e andranno inviate a info@wispmax.com

I’Acquirente, ricevuta l’autorizzazione al rientro è tenuto a spedire a proprio rischio e spese il prodotto eventualmente difettoso.

In seguito alla richiesta, se questo viene autorizzato viene comunicato al cliente il codice RMA di rientro.

Il cliente deve spedire la merce da rientrare all’indirizzo che verrà comunicato, indicando bene in vista sulla confezione del pacco il codice RMA che gli è stato comunicato.

Tutti i prodotti che verranno spediti in assistenza senza autorizzazione di Townet non saranno accettati. Le spese per le restituzioni di tali prodotti rimangono a carico dell’Acquirente.

Le apparecchiature vanno spedite in porto franco, pena il mancato ritiro da parte del centro di raccolta.

Le apparecchiature verranno prima controllate, quindi si deciderà, a seconda delle circostanze, se sostituirle o inviarle in riparazione.

La garanzia per materiali di consumo come lampade, batterie e simili è limitata a 30 giorni dalla consegna o spedizione.

Le spese di spedizione per l’invio delle apparecchiature al costruttore, per il rientro dal costruttore e per la restituzione al cliente sono a carico di Wispmax. 

Se un cliente manda un prodotto in RMA fuori garanzia, o che risulta perfettamente funzionante dopo le dovute analisit, dovrà acquistare nr.1 Fixed Charge Ticket per ogni prodotto in questione. Dopo l’acquisto del Fixed Charge Ticket, Townet rispedirà il prodotto al cliente, addebitando le relative spese di spedizione. 

11. Responsabilità

L’Acquirente con I’ordine si assume la responsabilità dell’osservanza delle norme di legge e di sicurezza relative all’impiego dei prodotti acquistati.

E’ esclusa pertanto ogni responsabilità del Fornitore per ogni e qualsiasi danno diretto o indiretto causato a persone o cose dall’impiego improprio dei prodotti forniti.

II Fornitore in nessun caso può essere ritenuto responsabile, anche indirettamente, del mancato o insufficiente funzionamento dei prodotti e/o dei danni conseguenti.

12. Legge applicabile e rinvio

I contratti stipulati online dal Cliente con Townet sono regolati dalla legge italiana;

per quanto qui non espressamente disposto, valgono le norme di legge applicabili ai rapporti ed alle fattispecie previste nel contratto stipulato online dal Cliente con Townet;

Ai sensi degli artt. 1341 e 1342 c.c., il Cliente dichiara di aver letto attentamente e di accettare espressamente le clausole delle Condizioni Generali di vendita di Townet.
